OX9.APP ("OX9", "we", "us", "our") is a service operated by SCOTT&YOUNG LTD, a company registered in England and Wales.

2. About these Terms
These Terms & Conditions ("Terms") govern your access to and use of the OX9.APP website and progressive web app, and any related services, features and content (together, the "Service"). By creating an account, subscribing, listing, redeeming an offer, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
These Terms should be read together with our Privacy Policy, Data Policy and Cookie Policy, which are incorporated by reference.
We may update these Terms from time to time (see section 18). The version in force is the one published on the Service at the time you use it.
3. What OX9 is
OX9.APP is a hyperlocal, two-sided community marketplace for Thame, Oxfordshire (postcode district OX9), delivered as a progressive web app. The Service brings together:
- a business directory in which local businesses can hold a subscription-based listing;
- a promotions and redemption engine through which businesses offer, and consumers redeem, deals;
- a consumer loyalty programme, which is free to consumers;
- a free town-information hub, including local events; and
- an events feature through which organisers can list events in the town.
OX9 is a platform and introduction service. Except where we expressly state otherwise, we are not a party to any contract, transaction, sale, booking or arrangement made between a consumer and a business, or between an attendee and an event organiser. We do not supply the underlying goods, services, offers or events listed by businesses or organisers.
4. Eligibility and accounts
You must be at least 16 years old to create a consumer account. You must be at least 18 years old and have authority to bind the relevant business to use paid business-membership or event-organiser features.
Accounts are secured using email magic-link sign-in. You are responsible for keeping access to your email account secure and for all activity under your OX9 account. Tell us promptly at beetge31@gmail.com if you believe your account has been accessed without your authority. You must provide accurate information and keep it up to date.
We may suspend, restrict or close an account that breaches these Terms, that we reasonably believe is being used unlawfully or fraudulently, or where required by law.
5. Consumer use
Core consumer use of OX9 is free. An optional paid membership, OX9 Gold, is available — see section 6A. Consumers can browse the directory, view businesses and events, save favourites, receive in-app notifications, and take part in promotions and the loyalty programme.
6. Consumer loyalty programme
The loyalty programme is free and offered at our discretion as a benefit, not a right.
- Redemptions and any resulting discounts (for example, tiered discounts based on qualifying redemptions in a rolling period) are as described in the Service at the time.
- Loyalty benefits, points, redemptions and discounts have no cash value, are non-transferable, and cannot be exchanged for money.
- We may change, suspend or withdraw the loyalty programme, or any part of it, at any time. Where a change materially reduces benefits you have already qualified for, we will act reasonably.
- Individual offers are provided by participating businesses. The business is responsible for honouring its offer at the point of sale. If a business does not honour a valid offer, tell us and we will follow up, but we are not liable for the business's failure to honour it (see section 15).
6A. OX9 Gold — optional consumer membership (paid)
OX9 Gold is an optional paid membership. Core consumer use of OX9 remains free; OX9 Gold unlocks member-only offers from participating businesses and event organisers and a personal savings tracker. It does not guarantee any particular offer, saving, or number of participating businesses.
Plans and price (inclusive; no VAT applies):
- Monthly — £5.00 per month, billed monthly in advance.
- Annual — £50.00 per year, billed annually in advance.
Automatic renewal. Your membership renews automatically at the end of each billing period at the then-current price using your stored payment method, until you cancel. If the price changes, we will give you clear advance notice before it applies to you.
Cancellation. You can cancel at any time from your OX9 profile (Manage membership). Cancellation stops future renewals; your membership stays active until the end of the period already paid for. Except where the law requires (see cooling-off below), we do not refund the unused part of a period.
14-day cooling-off (Consumer Contracts Regulations 2013). If you are a consumer you may cancel within 14 days of starting the membership for any reason. If you asked us to start providing member benefits during that period and then cancel, we may charge for the value of what you used up to cancellation. To exercise this right, contact beetge31@gmail.com or cancel via your profile within 14 days; any refund due will be made within 14 days of being informed.
Failed payments. If a renewal payment fails we may retry and may suspend member benefits until payment succeeds. If it is not resolved, the membership may be cancelled.
Member offers. Member offers are redeemed in person through the OX9 Show & Confirm flow, are limited to one redemption per member per offer, and are personal to your account and non-transferable. Participating businesses set and fund their own offers; OX9 is not the seller of the underlying goods or services.
Payments are processed by Stripe; we do not store your card details.
7. Business memberships (paid)
Businesses may purchase an annual membership to hold a listing and access member features (including analytics and the ability to post specials/offers).
Pricing (current, inclusive — no VAT applies as we are not VAT-registered):

- Founding cap: founding pricing is available only while founding places remain (cap of 50) and is enforced at checkout. Once the cap is reached, only standard membership is available.
- Founding price lock: a founding member's annual price remains £95.94 for as long as their membership renews continuously without lapse. If a founding membership lapses, the founding price and place are not guaranteed to remain available.
- Term and renewal: membership runs for 12 months from the date of payment. Renewal terms (including whether renewal is automatic) are as presented at checkout at the time of purchase.
- What membership includes: a directory listing, member analytics, and the ability to post specials/offers, plus any other benefits described in the Service. Benefits may evolve; we will not materially reduce a paid benefit during a paid term without offering a reasonable remedy.
- Payment: payments are processed by Stripe. We do not store your full card details. You must be authorised to use the payment method.
- Invoices: a paid invoice (receipt) is generated and made available for every payment.
- Listing content: you are responsible for the accuracy, legality and upkeep of your listing and offers. You grant us a licence to display your content as set out in section 12.
8. Business cancellation and refunds
Consumer-facing note: where the law grants you a statutory cancellation right, nothing in these Terms removes it.
- Business memberships are business-to-business annual purchases. Unless we state otherwise at checkout or agree otherwise in writing, business memberships are non-refundable once the membership term has started, because the listing and member features are made available immediately.
- If we materially fail to provide the membership you paid for and do not remedy it within a reasonable time after you tell us, you may be entitled to a proportionate refund.
- Where any purchaser qualifies as a "consumer" under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and has a statutory 14-day cancellation right for digital services, that right applies except where you have asked us to begin, and we have begun, providing the service within the cancellation period and you acknowledge the loss of the cancellation right on full performance.
9. Event listings and organisers
Event organisers may claim and list events through the Service.
- Listing flow: claim → confirm details → organiser profile → event listing page. Publication is immediate; there is no approval-first gate. We may nonetheless remove or amend listings under section 13.
- Rate card (current, per event; a listing runs for 12 months with unlimited updates unless removed): Community/Charity free · Local £20 · Commercial £60 · +£35 Featured · Season £150 · Major POA.
- Payment window: where a fee applies, the organiser has 30 days from listing to pay. If payment is not made within 30 days, the listing is delisted and the organiser profile is locked. To unlock, the organiser must contact us at beetge31@gmail.com.
- Organiser responsibility: organisers are solely responsible for the accuracy, legality, safety, licensing and delivery of their events. OX9 is not the event organiser and is not responsible for events, ticketing, admission, cancellations or refunds between organisers and attendees.
- Invoices: a paid invoice is generated for every paid event listing.
10. Advertising and partner placements
We may display advertising and sponsored placements, including a member banner included with membership and a separate partner-advertising system operated by us. Advertised or sponsored content is the responsibility of the advertiser. Inclusion of an advertisement is not an endorsement. Advertising terms and rates are as separately agreed and/or published.
11. Payments, pricing and invoices
- Prices are shown in pounds sterling (£). As we are not VAT-registered, no VAT is added.
- Payments are handled by Stripe. By paying, you agree to Stripe's applicable terms in addition to ours.
- We issue an automatically generated paid invoice/receipt for each successful payment, which is stored and backed up.
- We may change prices from time to time; changes do not affect a term already paid for (and, for founding members, are subject to the founding price lock in section 7).
12. Your content and licence
You may submit content (for example business details, offers, event details, images and profile information) ("Your Content"). You keep ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for formatting and display), publish and display Your Content for the purpose of operating and promoting the Service.
You confirm that you have the rights to submit Your Content, that it is accurate and not misleading, and that it does not infringe anyone's rights or break any law. You are responsible for having any rights and consents needed for images and other material you upload.
13. Acceptable use
You agree not to:
- use the Service unlawfully, fraudulently or for any harmful purpose;
- post content that is false, misleading, defamatory, obscene, discriminatory, infringing or otherwise unlawful;
- impersonate others, or claim a business or event you are not authorised to represent;
- attempt to gain unauthorised access to the Service, other accounts, or our systems; interfere with the Service; or circumvent security, membership gating or payment;
- scrape, harvest or bulk-extract data from the Service except as expressly permitted; or
- upload malware or content that is technically harmful.
We may remove content, and suspend or restrict access, where we reasonably consider these Terms have been breached or to comply with the law.
14. Availability, beta and changes to the Service
The Service is under active development and some features may be provided on a trial or evolving basis. We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may add, change, suspend or withdraw features. We will give reasonable notice of significant changes that materially and adversely affect paid users where we can.
15. Our responsibility to you
Nothing in these Terms limits or excludes our liability where it would be unlawful to do so — including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any statutory rights that cannot be excluded.
Subject to that:
- We are not a party to transactions, offers, bookings or events between users, businesses and organisers, and we are not liable for their acts, omissions, goods, services, offers or events, including a business's failure to honour an offer or an organiser's conduct of an event.
- We provide the Service on an "as available" basis and, to the extent permitted by law, exclude implied warranties not expressly stated in these Terms.
- We are not liable for loss that is not reasonably foreseeable, for business losses (such as loss of profit, revenue, goodwill or anticipated savings) where you use the Service other than as a consumer, or for loss caused by events outside our reasonable control.
- Where we are liable to a paying business user, our total liability arising from or in connection with the Service in any 12-month period is limited to the fees that user paid to us in that period.
If you are a consumer, you have legal rights under the Consumer Rights Act 2015 and other consumer-protection law; nothing in these Terms affects those rights.
16. Indemnity (business and organiser users)
If you use the Service as a business or event organiser, you agree to indemnify us against reasonable losses, costs and claims we suffer arising from your breach of these Terms, your content, your offers, or your events.
17. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or end your access if you materially breach these Terms, if we are required to by law, or if we reasonably need to protect the Service or other users. Provisions that by their nature should survive termination (including sections 12, 15, 16, 19 and 20) continue to apply.
18. Changes to these Terms
We may update these Terms to reflect changes to the Service, the law, or how we operate. We will post the updated version with a new effective date and, for material changes affecting paid users, take reasonable steps to notify them. Continued use after changes take effect means you accept the updated Terms.
19. Governing law and jurisdiction
These Terms and any dispute arising out of them are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, except that if you are a consumer resident elsewhere in the UK you may also bring proceedings in your local courts.
20. General
- If any provision is found unenforceable, the rest remains in force.
- Our failure to enforce a right is not a waiver of it.
- You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a business reorganisation or sale, without reducing your rights.
- These Terms are the entire agreement between you and us regarding the Service.
